Terms of Service for CheeHuu

Welcome to CheeHuu. These Terms of Service ("Terms") govern your use of the CheeHuu mobile application (the "App") and any related services. By creating an account or using the App, you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

By accessing or using CheeHuu, you agree to these Terms. If you do not agree, do not use the App. We may update these Terms from time to time; continued use after changes constitutes acceptance.

2. Description of Service

CheeHuu is a community platform for the maritime community. It includes:

  • Feed & Posts: Share and view posts, tips, photos, and content from other users
  • Experiences: Discover and contribute to spots (e.g., anchorages, snorkel spots, restaurants)
  • Messaging: Direct messaging between users
  • Map & Location: View your position and nearby users/experiences; optional live location sharing
  • Anchor Alarm: A GPS-based alarm that alerts you if your boat drifts beyond a set radius from your anchor position (uses background location when active)
  • Profiles: Create a profile with your role, boat information, and more

3. Account Terms

  • You must be at least 13 years old to use the App.
  • You must provide accurate information when creating an account.
  • You are responsible for keeping your account credentials secure and for all activity under your account.
  • You may delete your account at any time via Profile → Account → Danger Zone → Delete Account. Account deletion is permanent and removes your data as described in our Privacy Policy.

4. User-Generated Content

4.1 Your Content

You retain ownership of content you post. By posting, you grant CheeHuu a non-exclusive, royalty-free, worldwide license to use, display, store, and distribute your content to operate and improve the App.

4.2 Zero Tolerance for Objectionable Content

We have zero tolerance for objectionable or abusive content or behavior. You must not:

  • Post content that is illegal, harmful, threatening, harassing, defamatory, obscene, sexually explicit, or otherwise objectionable
  • Post spam, misinformation, or hate speech
  • Harass, bully, or intimidate other users
  • Impersonate others or misrepresent your identity
  • Share another person's private information without consent

Violations may result in removal of content, suspension, or permanent termination of your account.

4.3 Content Moderation

  • Reporting: You can report objectionable content (posts, replies, messages, experiences) and users through in-app report options.
  • Blocking: You can block users who bother you. Blocked users are removed from your feed and cannot interact with you; blocking also notifies us of potential abuse.
  • Our Response: We review reports and aim to act on objectionable content within 24 hours by removing violating content and taking action against offending accounts where appropriate.

5. Location and Anchor Alarm

  • Location: Some features (map, nearby users, live sharing, Anchor Alarm) require location access. Location is used only when you grant permission and enable these features.
  • Anchor Alarm: The Anchor Alarm monitors your boat's position and alerts you if you drift beyond a set radius. This feature uses background location when the alarm is active. It is a tool only—you remain solely responsible for vessel safety, watch-keeping, and compliance with maritime regulations. CheeHuu does not guarantee the alarm will alert you in all conditions (e.g., GPS drift, signal loss, device sleep).

6. Prohibited Conduct

In addition to Section 4 (User-Generated Content), you must not:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App, other accounts, or our systems
  • Scrape, crawl, or use automated means to collect data from the App without permission
  • Interfere with or disrupt the App or servers
  • Use the App to distribute malware or harmful code

7. Intellectual Property

CheeHuu, the CheeHuu logo, and other App branding are our intellectual property. You may not copy, modify, or create derivative works without our written permission.

8. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

CheeHuu is a community and information platform. Content shared by users (including tips, spots, and advice) is not verified by us. Always use your own judgment, especially regarding navigation, anchoring, and marine safety.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHEEHUU AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP OR ANY CONTENT THEREIN. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, IF ANY.

10. Indemnification

You agree to indemnify and hold CheeHuu and its affiliates harmless from any claims, damages, or expenses (including legal fees) arising from your use of the App, your content, or your violation of these Terms.

11. Termination

We may suspend or terminate your account if you violate these Terms or for operational reasons. You may terminate your account at any time via the in-app deletion option (Section 3).

12. Governing Law

These Terms are governed by the laws of [INSERT JURISDICTION, e.g., the State of Delaware, United States], without regard to conflict of law principles.
